Terms of Service

GamerNew ("we", "us") operates the GamerNew platform at gamernew.com: living game worlds, persistent AI agents, multiplayer sessions, creation tools, social features and paid memberships. By creating an account or using the platform you agree to these terms. If you don't agree, don't use GamerNew.

You must be at least 13 years old (or the minimum age in your country) to create an account, and at least 18 to purchase a membership. You are responsible for your password and for everything done with your account. Keep your email current so we can reach you about your account and billing.

One person, one account. Handles are yours while your account is active; we may reclaim handles that impersonate others, infringe rights, or are abandoned.

You own what you author: world concepts, configurations, agent identities, posts and text you write. You grant GamerNew a worldwide, non-exclusive, royalty-free licence to host, store, process, display, transmit and adapt that content as needed to run the platform — including having AI systems process it, displaying public worlds to other players, generating preview cards, and allowing remixes where you've made a world public.

Public worlds are remixable by other members. A remix records its origin. If you make a world unlisted or private later, existing remixes remain.

Agent behaviour, world events and other machine-generated output in your worlds are produced by automated systems from your configuration and player activity. You may use that output, but it is provided as-is and may be inaccurate, surprising or unsuitable for some purposes.

Don't use GamerNew to: harass, threaten or abuse people; post sexual content involving minors or non-consenting people; incite violence or hatred against protected groups; impersonate others; infringe copyrights or trademarks; distribute malware; attempt to manipulate AI agents or world state to break these rules; scrape the platform; probe or attack our infrastructure; or evade rate limits, entitlement checks or payment.

Worlds are fiction and may explore dark themes. The line is real-world harm: content that targets real people, promotes real violence, or sexualises minors is removed and may lead to account termination.

Paid memberships (Pioneer, Architect, Sovereign) are monthly subscriptions billed through PayPal at the price shown at checkout. They renew automatically until cancelled. You can cancel from your account page; access continues to the end of the paid period. Fees are non-refundable except where required by law or where we choose to refund at our discretion.

Membership levels change limits (worlds, agents, players, cognition turns, version history, memory depth). Daily cognition allowances reset at 00:00 UTC and do not roll over. If a payment fails, your membership may be suspended and free-tier limits applied.

We may change prices with at least 30 days' notice; changes apply from your next renewal after the notice period.

Agents are automated. Their statements are not GamerNew's statements and are not advice of any kind. We apply safeguards (validated actions, fenced player input, output validation) but cannot guarantee any particular agent behaviour. Do not rely on agents for factual, medical, legal or financial information. Do not share sensitive personal information with agents; it may be stored as agent memory.

GamerNew is evolving. We may add, change or remove features, limits, and AI providers. We aim for high availability but do not guarantee uninterrupted service. World state is persisted in our database; we take reasonable measures to protect it but cannot guarantee against loss. Export what matters to you.

You can close your account at any time by contacting us; we will delete or anonymise your personal data as described in the Privacy Policy. We may suspend or terminate accounts that violate these terms, with notice where practical. Sections that by their nature should survive (content licence for remixes already made, limitation of liability, disputes) survive termination.

The GamerNew name, logo, sigil system, interface and software are ours. These terms don't grant you rights to our brand. Feedback you send us may be used without obligation.

GamerNew is provided "as is" and "as available" without warranties of any kind, express or implied. To the fullest extent permitted by law, GamerNew is not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill, arising from your use of the platform. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

These terms are governed by the laws of the jurisdiction in which GamerNew is established, without regard to conflict-of-law rules, and disputes will be resolved in the courts of that jurisdiction unless applicable consumer law gives you the right to bring claims where you live.

We may update these terms. Material changes will be announced in the app or by email at least 14 days before they take effect. Continuing to use GamerNew after that means you accept the new terms.
